Fatal Semi vs. Pedestrian Crash in Punta Gorda Puts Spotlight on Pedestrian Safety

At All Injuries Law Firm, we have represented countless families affected by pedestrian accidents across Southwest Florida. These incidents highlight a sobering truth: pedestrians remain vulnerable even when drivers are obeying traffic laws. Large vehicles like semi-trucks need more distance to stop, and at night, drivers’ ability to see someone crossing the road is sharply reduced.
Florida law clearly places responsibility on both drivers and pedestrians to act responsibly. Under Florida Statute § 316.130(15), drivers must exercise due care to avoid colliding with pedestrians and give warning when necessary—even more so around children or impaired individuals. Likewise, pedestrians are required to obey traffic devices and avoid stepping into traffic when it's unsafe, reinforcing that sidewalk crossings and visibility matter for everyone’s safety. Drivers must yield the right of way in marked crosswalks and always remain alert, while pedestrians should only cross at intersections or designated crossings, and never assume a driver can see them clearly at night.
Unfortunately, too many crashes occur on multi-lane roads without proper lighting or crossing signals, particularly in high-speed "stroads" areas like Jones Loop Road in Charlotte and DeSoto Counties where traffic often includes heavy trucks traveling at highway speeds, but still has intersections and cross roads.
When a tragedy occurs, families may feel overwhelmed not only by their loss but also by the complex legal and insurance issues that follow. Our attorneys help victims and their families understand their rights, investigate contributing factors like roadway design, lighting, and driver conduct, and pursue the compensation they deserve.

This heartbreaking loss underscores the importance of pedestrian safety, especially at night. Reduced visibility and the speed of large trucks can make road crossings particularly dangerous. Pedestrians are urged to use crosswalks and well-lit areas, and drivers must remain vigilant, especially after dark.
